By requesting services, estimates, or using our website, you agree to these terms. Estimates & Pricing Estimates are based on visible conditions and information provided at the time. Hidden conditions (rock, buried debris, utilities, unstable soil, weather issues, etc.) may result in additional costs. Written estimates are generally valid for 30 days unless stated otherwise. Payment Terms Unless otherwise agreed in writing: Payment is due upon completion of work or according to invoice terms. Deposits may be required before scheduling certain jobs. Late payments may incur interest, fees, or collection costs. Site Conditions & Customer Responsibilities Property owners or customers agree to: Provide safe access to the job site Clearly identify property boundaries Disclose or mark known underground utilities, septic systems, wells, irrigation lines, or hazards Apex Grading LLC is not responsible for damage to: Unmarked utilities or private lines Structures or systems not disclosed prior to work Unknown subsurface conditions. Permits & Compliance Unless specifically agreed in writing: Property owners are responsible for required permits, zoning compliance, and inspections. Apex Grading LLC may assist with permits if arranged beforehand. Weather & Scheduling Excavation and grading work is heavily weather-dependent. We reserve the right to: Delay or reschedule work for safety or quality reasons Adjust timelines due to weather, site conditions, or unforeseen circumstances. Liability Limitations To the fullest extent allowed by law: Apex Grading LLC is not liable for indirect, incidental, or consequential damages. Liability is limited to the value of services provided. Changes to Scope of Work Changes requested after work begins may: Affect pricing Extend timelines Require written approval. Workmanship Disclaimer We stand behind our workmanship; however: Soil movement, drainage, weather conditions, or third-party work can affect results. No guarantee is made against natural settling, erosion, or environmental changes unless specifically stated in writing. Cancellation Policy Job cancellations after scheduling may result in charges to cover lost time, mobilization, or preparation costs.
